Terms of Service — Chip's Jack Machine

These Terms of Service (“Terms”) govern your use of the Chip's Jack Machine mobile application (the “App”), published by TapTap Performance LLC (“we,” “us,” or “our”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. The App and what it does
Chip's Jack Machine is a classic Chicago-house drum machine for iOS. It features 11 drum voices (kick, snare, low tom, mid tom, hi tom, clap, closed hi-hat, open hi-hat, ride, crash, and cowbell), a step sequencer with up to 32 steps per pattern, scene management for arranging patterns into full tracks, adjustable swing, per-step velocity and accent controls, and audio export so you can share or use your beats in other projects.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App.
3. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own purposes, subject to these Terms and the Apple Media Services Terms and Conditions. You may not copy, modify, reverse-engineer, resell, or redistribute the App except as permitted by law.
4. User content
Beat patterns, step sequences, scenes, voice configurations, and exported audio files you create are your content. You retain full ownership of your content. All content is stored locally on your device — we do not upload, access, or claim any rights to your beats, patterns, or audio exports. You are responsible for backing up your own content.
5. Subscriptions and purchases
Chip's Jack Machine offers subscription-based access to premium features through auto-renewing subscriptions managed by Apple StoreKit:
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours prior to the end of the current period.
- Any unused portion of a free trial is forfeited when you purchase a subscription.
- You can manage or cancel subscriptions in your device Settings → [your name] → Subscriptions.
Prices are shown in the App and may vary by region and over time. Purchases are processed by Apple; refunds are handled by Apple under its policies, not by us.
6. Data storage
All data is stored locally on your device. We do not operate servers that store your content. Deleting the App removes all locally stored data. See our Privacy Policy for full details on data handling.
7. Disclaimers
THE APP AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT AUDIO OUTPUT WILL MEET YOUR SPECIFIC REQUIREMENTS.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, BEATS, PATTERNS, AUDIO FILES, OR PROFITS ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $25. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
9. Changes
We may update the App and these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Continued use after changes means you accept the revised Terms.
10. Termination
We may suspend or terminate your access if you violate these Terms. You may stop using the App at any time. Sections that by their nature should survive (disclaimers, limitations, etc.) will survive termination.
11. Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules.
