Terms of Service — Speed Weather

These Terms of Service (“Terms”) govern your use of the Speed Weather mobile application (the “App”), published by Speed, Inc. and powered by TapTap Performance (“we,” “us,” or “our”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. The App and what it does
Speed Weather is a weather-intelligence tool for automotive enthusiasts. It interprets public weather data — air density, density altitude, temperature, humidity, pressure, wind, and related metrics — and presents performance-oriented estimates such as the Speed Index, Race Readiness, projected horsepower impact, and an estimated track-surface trend.
All scores, projections, ranges, and recommendations in the App are informational estimates, not guarantees. They are derived from third-party forecasts and physical models and may be inaccurate, incomplete, or unavailable. Weather coverage currently relies on the U.S. National Weather Service and is limited to the United States.
2. Not professional advice; assumption of risk
The App does not provide safety, mechanical, tuning, racing, or professional advice. Motorsport and high-performance driving are inherently dangerous. You are solely responsible for your vehicle, your driving, your decisions about whether and when to drive or race, and for complying with all laws, track rules, and safety requirements. Never rely on the App for safety-critical decisions. Do not interact with the App while driving.
3. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App.
4. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial purposes, subject to these Terms and the Apple Media Services Terms and Conditions. You may not copy, modify, reverse-engineer, resell, or redistribute the App except as permitted by law.
5. Subscriptions and purchases
Speed Weather offers Speed Weather Pro as auto-renewing subscriptions and a one-time purchase:
- Monthly — $1.99 USD / month, with a 7-day free trial for new subscribers
- Annual — $9.99 USD / year, with a 7-day free trial for new subscribers
- Lifetime — $29.99 USD, one-time, non-consumable
Billing terms (auto-renewing subscriptions):
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours prior to the end of the current period.
- Any unused portion of a free trial is forfeited when you purchase a subscription.
- You can manage or cancel subscriptions in your device Settings → [your name] → Subscriptions.
Prices are shown in the App and may vary by region and over time. Purchases are processed by Apple; refunds are handled by Apple under its policies, not by us.
6. User content
Vehicle names, photos, run logs, time-slip images, and notes you enter are stored locally on your device. You are responsible for the content you create and for not uploading anything unlawful or infringing. We do not claim ownership of your content.
7. Third-party data and services
The App uses third-party data and services, including the U.S. National Weather Service, Open-Meteo, Iowa State University (NEXRAD radar tiles), the NHTSA vPIC database, Apple Maps/MapKit, Apple StoreKit, and RevenueCat. We do not control and are not responsible for third-party data accuracy or availability. Your use of those services may be subject to their own terms.
8. Disclaimers
THE APP AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP OR ANY ESTIMATE, FORECAST, OR SCORE WILL BE ACCURATE, RELIABLE, TIMELY, OR UNINTERRUPTED.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, VEHICLES, PROPERTY, OR INJURY, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $25. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
10. Changes
We may update the App and these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Continued use after changes means you accept the revised Terms.
11. Termination
We may suspend or terminate your access if you violate these Terms. You may stop using the App at any time. Sections that by their nature should survive (disclaimers, limitations, etc.) will survive termination.
12. Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules.
